Copyright, Artist Likeness and Usage Rights in AI Video Production

Why rights are part of an AI video brief

Generating images with AI does not mean every asset in the project is automatically free to use. The song, the artist’s face, the voice, the logo, the brand’s product, archive footage, photographs, characters and third party images each need their usage scope checked.

This article is not legal advice. It is a production checklist of what to ask at the start of a professional AI video project. For a definitive legal view, speak to a qualified lawyer in the relevant country.

Which assets to check

AssetThe question to ask
MusicIs there a right to use the song and the master recording in a video?
Artist’s faceWhich visual references will be used, and on which platforms will it be published?
VoiceIs there explicit permission for voice cloning or an AI voice?
Logo and productWhat is the scope for using brand assets in generated images?
Photographs and archiveAre the source and licence known?
CharactersIs there a risk of resembling an existing character or franchise?
Client materialWho may use the footage sent with the brief?
Generated outputHow does the contract define delivery and usage rights?

Artist likeness and the use of a face

Using a real artist’s face in AI production takes more than preparing a good technical reference. Which photographs may be used, how far the image represents the artist, paid versus organic use, countries, duration and revisions should all be agreed in writing at the start.

When an artist appears with their own face in a music video, approval should not end with the first moodboard. The character sheet, the first scene set, the rough cut and the final material can all be checked. Productions that imitate an artist’s face without permission or use it out of context should be avoided. More on this in artist likeness in AI music videos.

Voice-over and voice cloning

AI voice-over and voice cloning are not the same thing. A generic synthetic voice and a voice that resembles or uses a specific person raise different permission and usage questions. Whose voice it is, who approves the script, whether it will be used in advertising and for how long should all be settled.

Brand and product images

In an AI commercial the product, packaging, logo or brand character has to look right. If the product’s shape, colour, lettering or function changes, the message suffers. An approved product reference and the brand guidelines should be ready before production, and the logo, lettering, product form and brand tone checked in the final.

Leopati’s AI commercial production page explains how the brief, brand identity, colour, typography, product images, media channels and any shot footage enter production. Preparing this way helps manage legal and creative risk together.

A rights file for every project

Each project can keep a short rights file: the sources used, the assets the client supplied, who holds the permission, the area of use, the publishing period, countries and channels, approval dates and restrictions. It becomes a shared reference for production, the client and, where needed, the legal team.

Transparency and AI disclosure

Whether the client, the platform or the audience should be told about AI use depends on the project and the publishing policy. In documentaries, historical films, biographies and true stories it should be especially clear whether an image is a dramatisation or a real record. This is how Leopati labels AI-generated work.

FAQ

Can every AI-generated image be used freely? No. Source assets, brand and personal rights, music and the terms of the tools used all need checking.

Can an artist’s face be used? It can be planned once explicit approval and the scope of use are set.

Where should usage rights appear in a quote? They should be written clearly in the contract, according to scope, platform, duration, country and the fee model.

Is legal advice needed? For risky or commercially high-impact projects, speak to a qualified lawyer.
